This policy explains what personal information we collect, how we use, store and share it, and how you can access it or make a complaint.
1. About this Policy
Gnarly Constructions Pty Ltd (ABN 59 632 223 655) handles personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. This policy applies from 4 November 2026.
2. What We Collect and How
We collect names, contact details, site addresses, job details, plans and reports, site photos, and quote, invoice and payment records from customers, builders, suppliers and subcontractors, plus resumes and tickets from job applicants. When you open, accept or decline a quote or variation online, we record the time, your IP address and device, and your name and signature if you accept. We also record when an invoice we send you is opened.
We collect it from you directly, from your builder, certifier or engineer, from public property and licence records, through the enquiry form on our website, through cookies and tracking tools on our website (see section 5), and through photos and video on site. We don’t usually collect sensitive information, and we don’t store card numbers. You can make a general enquiry without giving your name, but we need your details to quote or carry out work.
3. How We Use and Share It
We use it to:
• quote, contract, carry out and invoice work
• send reminders about quotes, bookings and overdue invoices
• meet QBCC and other legal obligations
• handle warranty and insurance matters
• recover unpaid amounts
• measure and improve our website and advertising
We share it only as needed with the QBCC, your builder, certifiers and engineers, suppliers and plant hire, Before You Dig Australia, our software and AI providers, our website and advertising providers (including Meta), accountants, lawyers, insurers and debt collectors, or where the law requires. We never sell it.
4. Photos and Video
We photograph and film every job, including by drone, as records that we don’t publish. We use photos for marketing only if you agree in your contract, and never show people, your address or anything that identifies your home. You can withdraw marketing consent at any time.
5. Our Website, Cookies and Advertising
Our website uses cookies and similar technologies. A cookie is a small file saved by your browser that helps a website remember information about your visit.
• Meta Pixel: we use the Meta Pixel (Facebook and Instagram) to measure how our ads perform and to show our ads to people who have visited our website. It collects information such as the pages you visit, actions you take (for example, submitting an enquiry), your IP address, and your browser and device details. Meta may link this to your Facebook or Instagram account and handles it under its own privacy policy at facebook.com/privacy/policy. Meta processes this information outside Australia, mainly in the United States.
• Enquiry and quote forms: the forms on our website are provided by Jotform. The details you enter are sent to us and stored by Jotform, which may store them outside Australia, including in the United States.
• Website content and widgets: our website is built and hosted on Showit, and some content, such as customer reviews, is shown using Elfsight. These providers may collect basic technical information, such as your IP address and browser type, to display the website and its content.
We don’t use this information to identify you personally unless you give us your details, for example through an enquiry form. You can block or delete cookies in your browser settings, and you can control how Meta uses your information for ads in your Facebook or Instagram ad settings or at facebook.com/adpreferences. Blocking cookies won’t stop you using our website, but some features may not work as intended.
6. Software, AI and Automated Decisions
We use software and AI tools, such as job management, accounting, email and cloud storage software and AI writing assistants, to prepare quotes, contracts, invoices and emails, schedule work and file job records. We use business versions of these tools, which don’t use your information to train their AI models.
These tools use names, contact details, site addresses, job details, plans and photos, the pricing level we set for you (for example, for returning customers), and quote, invoice and payment history. This is how they are involved in decisions:
• Reminders, sent by our system on its own: reminders about quotes, upcoming bookings and overdue invoices go out automatically by email or text, on a schedule we set.
• Quote prices: our quoting system works out quantities and prices from your job details and pricing level, and an AI assistant may help draft the quote. A staff member reviews and approves every quote before it is sent.
• Overdue accounts: our system tracks overdue invoices. Our staff decide any further steps, such as pausing work.
Apart from reminders, no decision about you is made solely by a computer program. If you’d like to know how a decision about you was made, or want a person to look at it again, contact us.
Our job management system is hosted in Sydney. Some of our other providers store or process information outside Australia, mainly in the United States.
7. Security and Retention
We store information electronically in secure cloud-based systems. We limit access to staff who need it, use passwords and multi-factor authentication, and keep job records for at least 7 years to cover building warranties and tax requirements, then delete them. If a data breach is likely to cause serious harm, we will notify you and the Office of the Australian Information Commissioner (OAIC).
8. Your Choices, Access and Complaints
You can unsubscribe from marketing at any time, and opt out of ad tracking as set out in section 5. You can ask to see or correct your information free of charge, and we will respond within 30 days.
If you have a complaint, contact us first. We will acknowledge it within 5 business days, look into it and aim to respond within 30 days. If you are not satisfied with our response, contact the OAIC at oaic.gov.au or on 1300 363 992.
